Sad to say, nullification is back in vogue as a legitimate policy position in the current Republican Party

It’s like the movie “Groundhog Day.”

Last year, the Missouri General Assembly passed a bill that would have made it illegal in Missouri to enforce federal gun laws, announced as a protection of our Second Amendment rights. It was vetoed by the governor, on the basis that it was unconstitutional. An override effort failed in the state Senate.

Last week, we woke up and it started all over again. Rep. Doug Funderburk, R-St. Peters, once again, sponsored a bill nullifying federal gun laws. Once again, the bill passed in the House, just as a similar bill passed in the Senate.

In a 1967 interview with the Los Angeles Times, actor-writer-producer Rod Serling offered this quote: “I happen to think that the singular evil of our time is prejudice. It is from this evil that all other evils grow and multiply. In almost everything I’ve written there is a thread of this: a man’s seemingly palpable need to dislike someone other than himself.”nullification-lg-2014 These words are both true and disappointing. How are we to describe politicians in certain states who are so intolerant, they willfully refuse to comply with federal laws?

Nullification was most famously invoked by segregationists like Alabama Governor George Wallace during the civil rights movement as he refused to obey a federal court order to desegregate the schools, citing states’ rights and Alabama’s sovereignty in nullifying a federal law he didn’t like.

It is not the first time in recent years that nullification has been endorsed by Republicans. Several GOP legislators addressed a nullification rally on the lawn behind the Legislative Building on the first day of the 2013 General Assembly session.

Here’s the question Missouri Republicans must ask themselves before they pass whatever version of this year’s federal gun nullification law they intend to send to Gov. Jay Nixon before the Democrat vetoes it:

Do they want federal law enforcement officials to properly investigate the horrific crimes carried out by Frazier Glenn Miller?
